1. Rules of providing the service of checking internet surfing security Surfpatrol.ru
1.1. About the service
Application of outdated versions of web browsers and plug-ins usually results in computer infection with viruses, loss of important information, and even material damages. Update systems control only operating system components; in practice, these are browser plug-ins that prove to be vulnerable, while the user can be even unaware of the necessity to update them.
Surfpatrol.ru developed by Positive Technologies CJSС (“Company”) allows one to make a rapid evaluation of the computer security level on the basis of information about web browser and its extensions. If you would like to allow the visitors of your site to check the security level of their computers, you can use a Surfpatrol.ru information banner (http://surfpatrol.ru/Banner).
- The Surfpatrol.ru Service is software that allows one to make a rapid evaluation of the computer security level on the basis of information about web browser and its extensions.
- The rightholder of the Surfpatrol.ru is Positive Technologies CJSС.
1.2.2. Service cost
Application of the Surfpatrol.ru Service and installation of a Surfpatrol.ru banner is free for natural persons.
Application of the Surfpatrol.ru Service and installation of a Surfpatrol.ru banner is free for artificial persons if the following conditions are fulfilled:
- secure SSL protocol is not used;
- the limit of 3000 visits per day is not exceeded;
- standard banners are used;
- the site is registered as a Service user via the “Feedback” feature.
To access advanced facilities (more than 3000 visits per day, SSL support, or original banners), you should contact the Surfpatrol.ru Service rightholder (https://www.surfpatrol.ru/Feedback).
1.2.3. Automated access
It is prohibited to use the tools of automated access to Service (robots, etc.).
Company monitors all actions relating to application of the Surfpatrol.ru Service and has the right to gather and analyze the statistics of User actions performed via the Service.
1.2.5. Access guarantee
Constant availability of the Surfpatrol.ru Service or any other Service component is not guaranteed. The Surfpatrol.ru Service is provided “as is”. The Company doesn’t guarantee compliance of the Service or its components with the User purposes and expectations, nor does it guarantee uninterrupted and error-free operation of Service. The Company does not have any responsibility to the User for actions performed via the Service. The Company doesn’t repair direct and consequential damages inflicted on the User or third parties as a result of application or impossibility of application of the Service or its separate components.
The Company can use their own discretion to set quotas on application of the Surfpatrol.ru Service and its components depending on certain factors.
1.2.7. Changing the terms of providing the service and termination of providing the service
1.2.8. Applicable law
The given Terms and all relations concerned associated with application of the Surfpatrol.ru Service and its components are regulated by Russian Federation law. All disputes relating to application of the Surfpatrol.ru Service must be arbitrated in accordance with Russian Federation law.
1.3. Gathering and applying information
The Surfpatrol.ru Service doesn’t require User registration or providing any personal data. To make a rapid evaluation of the computer security level, the Surfpatrol.ru Service gathers the following information about the computer:
- the name and exact version of browser used to view the web page with a Surfpatrol.ru banner;
- the names and exact versions of extensions of this browser;
- cookie values used to identify the computer being checked.
The gathered information about browser and its extensions is used to search for data about existing vulnerabilities in the Company knowledge base. The cookie values are generated at first loading of the web page containing a Surfpatrol.ru banner and are used to identify the computer in case of repeating loading of pages containing Service banners.
To gather information, standard features of HTML and User browser are applied. The Surfpatrol.ru Service doesn’t install any software to the computer being checked and doesn’t modify its settings.
The results of rapid evaluation of the computer security level are presented only to the computer User when he/she loads a web page containing a Surfpatrol.ru banner. The Company doesn’t give this information to third parties including the owners of web sites containing Surfpatrol.ru banners.
The information gathered in the course of rapid security evaluation is stored in depersonalized form and is used for the purposes of statistics analysis. The applied method of depersonalization excludes the possibility of computer identification on the basis of stored information. The Company reserves the right to publish the results of statistics analysis, but ensures confidentiality of information about the security level of separate computers.
In no circumstances will the Company gather and process information relating to the person of the Service User.

2. Surfpatrol.ru service license agreement
2.1. General provisions
2.1.1. This license agreement ("Agreement" or "License") represents an agreement between User ("End User") and Positive Technologies CJSC with regard to the Surfpatrol.ru software ("Surfpatrol.ru Service," "Software"). By using the Surfpatrol.ru Service User gives his/her consent to adhere to the conditions of this Agreement. If User doesn’t accept the terms of this License Agreement and Rules of Providing the Surfpatrol.ru Service fully and unconditionally, then he/she has no right to apply the Surfpatrol.ru Service for any purposes.
2.2. Permitted use
2.2.2. The Surfpatrol.ru service is meant for rapid evaluation of the computer security level on the basis of information about web browser and its extensions.
2.2.3. Application of the Surfpatrol.ru service is free except for the cases specified in the paragraph 1.2.2 of the Rules of Providing the Surfpatrol.ru Service.
2.2.4. The User may not modify, adapt, localize or decompile the Software except for the cases specified by the current legislation of the Russian Federation, nor may the User make any changes to the source code of the Software.
2.2.5. The User may not remove and/or change Positive Technologies CJSС copyright information.
2.2.6. he End User may not distribute, rent or lease the Software, or use it for fraudulent or other illegal purposes.
2.2.7. The End User may not perform any actions that do not comply with the conditions of this Agreement and the Rules of Providing the Surfpatrol.ru Service.
2.3.1. The rightholder of the software is Positive Technologies CJSС.
2.3.2. All rights (including the right for the content that can become available as a result of the Software use) are the property of the specified rightholder and are protected by the current RF legislation in the field of intellectual property.
2.3.3. All rights that were not directly and explicitly granted by this Agreement shall remain with Positive Technologies CJSС.
2.4. Limited warranty
2.4.1. Company gives no warranty of permanent availability and operation of the Software.
2.4.2. Positive Technologies CJSС gives no warranties that the Software is free from any faults. Also, Positive Technologies CJSС is not liable for direct or indirect damages resulting from potential faults in the Software, as well as damages that might result from use, or impossibility of use of the Software.
2.4.3. Positive Technologies CJSС gives no warranties that the Software complies with the End User requirements or expectations.
2.5.1. The User guarantees reparation of damages to Positive Technologies CJSС concerning any third party claims resulting from the use of the Software by the User.
2.5.2. The User shall be held liable for infringement of the conditions of this Agreement and the Rules of Providing the Surfpatrol.ru Service in accordance with the current RF legislation.
2.5.3. Infringement of the conditions of this Agreement and the Rules of Providing the Surfpatrol.ru Service may entail cessation of the right of the User to use the Software.
2.5.4. Nothing in this License Agreement can be interpreted as establishment of agent relationship, companionship, employment, or any other relationships that are not specified in this Agreement.
2.5.5. Inaction of Positive Technologies CJSС in case of breaking of some terms of this Agreement and/or the Rules of Providing the Surfpatrol.ru Service by the User doesn’t mean surrender of Positive Technologies CJSС of their rights and doesn’t prevent Positive Technologies CJSС from performing some actions to protect their rights in the future.
2.6. Other provisions
2.6.1. This Agreement is regulated by Russian Federation law.
2.6.2. If any item of this Agreement will be declared to be invalid by court, it will not make other items of this Agreement invalid, too.
2.6.3. Positive Technologies CJSС reserves the right to modify the conditions of this Agreement without preliminary notice of the User. Terms revision containing the latest changes comes into effect at the moment of its publication on the site https://www.surfpatrol.ru/ru/Terms.
2.6.4. For any inquiries related to the permitted use of the Software, the User may address the Software rightholder https://www.surfpatrol.ru/ru/Feedback.
